Regulations by USTC on the Student Disciplinary Sanctions

Article 1 For the purposes of maintaining the normal order of teaching and living, protecting the lawful rights and interests of the University and students, developing students’ morality and intelligence, and training qualified builders and successors of the cause of socialism, these regulations are formulated in accordance with Provisions on the Administration of Students in Regular Institutions of Higher Education, Code of Conduct for College Students, and relevant regulations made by the Ministry of Education, as well as the actual situation of our university.

Article 2 These regulations are applicable to the registered full-time undergraduates and postgraduates at the University of Science and Technology of China. They are also applicable to the freshmen who have registered and are still in the period of student status review. The disciplinary sanctions for students receiving adult higher education, students from Hong Kong, Macao and Taiwan, overseas Chinese, international students, non-formal education postgraduates and other types of students shall refer to these regulations.

Article 3 Disciplinary violations in these regulations refer to the violations of laws, regulations, rules, or other administrative systems of the University.

Article 4 The students who violate disciplines during off-campus activities such as off-campus teaching, internships, inspections, social practice, and on-the-job training, shall be given disciplinary sanctions in accordance with these regulations.

Article 5 The disciplinary sanctions follow the principle of justice, fairness and transparency, the principle of combining education and punishment, and the principle of collective discussion and majority rule. Disciplinary actions brought against student shall ensure procedural due process, sufficient evidence, accurate information, correct determination, and appropriate punishment.

Chapter II Organization

Article 6 The Student Affairs Office is responsible for the coordination and management of student disciplinary sanction.

Article 7 The University establishes a Student Appeals Committee, and its working organization is affiliated to the Party and Government Office to accept student appeals in accordance with the Regulations by USTC on Student Appeals (USTC [2007] No. 24).

Article 8 The types of disciplinary sanctions include:

(1) Warning;

(2) Serious warning;

(3) Demerit recording;

(4) Probation;

(5) Expulsion.

Article 9 The disciplinary sanctions imposed by the University shall be commensurate with the nature and severity of the student’s mistake.

Article 10 The probation is valid from the date of issuance of the sanction decision, and is valid for one year.

During the probation period, sanctions may vary according to the performances of the student:

(1) If the student shows regret and has made obvious progress, the probation period could be ended in advance upon the application by the student and approval from the Student Management and Consulting Working Group (hereinafter referred to as “Working Group”) of the school (department, or directly affiliated teaching unit), the Student Affairs Office and the President’s Office meeting;

(2) If the student does not violate the disciplinary regulations again, the probation period would be ended on schedule upon the application by the student and approval from the Working Group of the school (department, or directly affiliated teaching unit), the Student Affairs Office and the President’s Office meeting;

(3) If the student violates the disciplinary regulations again and can be subject to any type of the disciplinary sanctions according to the regulations, he/she shall be expelled from the University;

(4) If the student violates the disciplinary regulations again but the violation is not severe enough for a disciplinary sanction, the probation period could be extended by six months to one year depending on the circumstances after discussion at the President’s Office meeting, but the total probation period shall not exceed two years.

Article 11 The students who receive disciplinary sanctions will be disqualified for degrees, scholarships, recommended direct admission, and honorary titles, or be deprived of the honors and qualifications they have obtained. The concrete measures shall be formulated by the relevant offices of the University.

Chapter IV Disciplinary Authority, Procedure and Management

Article 12 The schools (departments, or directly affiliated teaching units) shall cooperate with relevant authorities at the University to conduct the fact investigation, evidence collection, punishment decisions, and filing of relevant materials in accordance with national laws and regulations, and rules made by the Ministry of Education, authorities and the University. The Student Affairs Office is responsible for reviewing cases.

Article 13 The Working Group of the school (department, or directly affiliated teaching unit) shall submit the opinions on the disciplinary sanctions and evidence and materials to the Student Affairs Office for reviewing. The Student Affairs Office shall report to the President’s Office meeting for discussion and decision-making.

If necessary, the Student Affairs Office can also directly report to the President’s Office meeting for discussion after notifying the student’s school (department, or directly affiliated teaching unit).

Article 14 The University shall issue a written decision on the disciplinary punishment.

Article 15 Prior to making a sanction decision, the student’s school (department, or directly affiliated teaching unit) shall inform the student of the sanction type and the facts, reasons, proof on which the disciplinary sanction decision is made. The student has the rights for appeal. If the student entrusts an agent to make the appeal, the identity of the agent shall be confirmed by the student in written form (see Annex 1).

Article 16 The written disciplinary decision shall be directly sent to the student concerned by the student’s school (department, or directly affiliated teaching unit), the Student Affairs Office, and other relevant authorities within 15 working days after the decision is made. The student shall sign and date the delivery notice (see Annex 2). If the student refuses to accept the disciplinary decision, the sender should truthfully record the refusal and the date, get another two witnesses to sign the delivery notice, and leave the disciplinary decision at the student’s residence, after which the disciplinary decision will be deemed to have been sent.

If the disciplinary decision cannot be sent to the student, it can be mailed to the adult family member of the student by registered mail from the Student Affairs Office. After 30 days from the date of delivery (the postmark date), it will be deemed to have been delivered. If it’s impossible to contact student concerned, the disciplinary decision shall be sent by the Student Affairs Office via USTC website in the form of public notice, and be deemed to have been sent 30 days after the public notice is announced. The reason and process of the announcement shall be truthfully recorded

Article 17 The following verified evidences can be used as the proof for disciplinary sanctions:

(1) Documentary evidence;

(2) Physical evidence;

(3) Witness testimony;

(4) Statement of the parties;

(5) Audiovisual materials;

(6) Appraisal conclusion;

(7) Inquiry transcripts and on-site transcripts;

(8) Explanatory materials provided by relevant authorities of the University;

(9) Appraisal conclusions made by other authorities according to laws.

Article 18 Where there is any of the following circumstances, sanctions must be more severe:

(1) The student is the leader or organizer of a group which violated disciplinary regulations;

(2) The student deliberately concealed, refused to admit, or quibbled about the disciplinary violation;

(3) The student threatened or retaliated against the informants or witnesses;

(4) The student violated the discipline again;

(5) The disciplinary violation caused serious consequences;

(6) The disciplinary violation happened outside the campus and caused a bad social influence.

Article 19 Where there is any of the following circumstances, sanctions shall be lessened, mitigated or exempted:

(1) The disciplinary violation caused little consequences;

(2) The student admitted mistakes and corrected in time;

(3) The student exposed other wrongdoers;

(4) The disciplinary violation happened due to force majeure or emergency avoidance.

Article 20 The disciplinary sanction cannot be withdrawn. Written decision on disciplinary sanction and relevant materials shall be kept in USTC administrative archives and personal archives of the student in a true and complete manner.

Article 21 Those who receive the disciplinary sanction of expulsion shall go through leaving school formalities within 15 days since the disciplinary decision is made. If student registered permanent residence has been moved to the University, it shall be relocated to the original place of registered permanent residence. Student archives shall be returned to his/her home domicile. The University will issue the student a certificate of study, and refund the tuition and related fees paid for the next semester. The students pay for his/her return journey. If the student does not go through the formalities for leaving school within the time limit, the student’s school (department, or directly affiliated teaching unit) will handle it in accordance with the prescribed procedures.

If the student makes an appeal to the University after receiving the expulsion decision and the review decision is to maintain the original one, the student must leave the University within 15 working days from the date of receiving the review decision. If the student makes an appeal to the higher education authority after receiving the University’s review decision and the review decision is maintained, the student must leave the University within 15 working days from the date of receiving the decision made by the higher authority.

Article 22 The expulsion decision must be reported to the Bureau of Personnel of the Chinese Academy of Sciences and Anhui Provincial Department of Education for the record.

Chapter V Appeal Procedure

Article 23 If the student disagrees with the sanction decision, he/she may submit a written appeal to the Student Appeals Committee in accordance with the Regulations by USTC on Student Appeals within 5 working days from the date of receiving the sanction decision. If there are still objections to the review decision, the student can submit a written appeal to the Bureau of Personnel of the Chinese Academy of Sciences or Anhui Provincial Department of Education within 15 working days from the date of receiving the review decision.

Article 24 The Student Appeals Committee shall review the appeals and inform the student of the review decision within 15 working days from the date of receiving the written appeal. If the original sanction needs to be changed, the Student Appeals Committee shall submit the decision to the President’s Office meeting for review. During the review period, the original sanction (except for the expulsion) shall be executed as usual.

Article 25 If the student does not make the appeal within the appeal period, the University or the higher education authority will no longer accept the appeal.

Chapter 6 Supplementary Provisions

Article 26 Student Affairs Office shall be responsible for the interpretation of the Regulations. The Regulations shall come into force since September 1, 2007. The original Regulations by USTC on the Student Disciplinary Sanctions (USTC [2005] No. 21) shall be abolished simultaneously.

Annex 1

USTC Disciplinary Sanction Decision

You and/or your agent shall make the appeal and submit the materials to the Student Management and Consulting Working Group of your school (department, or directly affiliated teaching unit) within 5 working days from the date of receiving this Decision. If you entrust an agent to make the appeal, the identity of the agent shall be confirmed in written form.

Annex 2

Delivery Notice for USTC Disciplinary Sanction Decision

Please sign and accept the document.

According to Article 23 of the Regulations by USTC on the Student Disciplinary Sanctions and Article 3 of the Regulations by USTC on Student Appeals, if you disagree with the sanction decision, you shall submit a written appeal to the Student Appeals Committee within 5 working days from the date of receiving the Disciplinary Sanction Decision. Any late appeals will not be accepted. If you entrust an agent to make the appeal, the identity of the agent shall be confirmed in written form.
